Nurtory Pty Ltd (ABN 60 697 775 027, "Nurtory", "we", "us" or "our") respects your privacy. This Privacy Policy explains what personal information we collect, why we collect it, how we use, store and disclose it, and how you can access, correct, or complain about that information.
This Policy applies to our website at nurtory.com.au (the "Website"), our Nurture Kit services and any other way you interact with us — including by phone, email, live chat, social media, or in connection with a competition or promotion we run (together, the "Services"). It does not apply to the practices of third parties we don't control, including third-party websites you may link to from our website.
Nurtory operates only in Australia. This Policy is designed to comply with the Australian Privacy Principles (APPs) under the Privacy Act 1988 (Cth) (the "Privacy Act"), and we intend to comply with it as a matter of good practice regardless of whether Nurtory currently meets the small business threshold under that Act. By using our Services, you agree to the collection, use, storage and disclosure of your personal information as described in this Policy. If you don't agree with this Policy, please don't use our Services.
2. What Personal Information We Collect
Depending on how you interact with us, we may collect the following personal information:
- Contact details — your name, email address, phone number, and delivery and billing address.
- Account information — login credentials, order history, delivery plan, billing cycle, and communication preferences.
- Child-related information — your child's date of birth, expected due date or age range, provided by you, used only to select and curate age-appropriate Nurture Kit contents and to send you updates relevant to your child's stage. We collect this information from you, the account holder, and not directly from your child.
- Payment information — processed securely by our third-party payment provider (Shopify Payments); Nurtory does not collect or store full card numbers.
- Communications — messages you send our customer support team, product reviews, survey responses, and competition or giveaway entries.
- Technical and usage information — your IP address, approximate location, browser type and operating system, device identifiers, and how you use our Website, collected automatically via cookies and similar technologies (see Section 9).
- Marketing preferences — whether you've opted in to receive marketing emails or SMS from us, and your engagement with those communications.
You may choose not to give us certain personal information, but this may mean we can't provide you with some or all of our Services — for example, we can't ship a Nurture Kit without a delivery address, or select age-appropriate contents without knowing your child's age range.
3. How We Collect Personal Information
We usually collect personal information directly from you — for example, when you join our waitlist, create an account, place an order, sign up to receive Nurture Kits, contact our customer support team, sign up for marketing, enter a competition, or otherwise use our Website.
We may also collect personal information:
- automatically, through cookies, pixels and similar technologies when you browse our Website (see Section 9);
- from our service providers, such as our e-commerce and payment platforms, where they collect information on our behalf in the course of processing your order; and
- from publicly available sources, or from third parties such as marketing platforms, where you've engaged with our advertising.
Where practical, we'll only collect personal information about you directly from you. If we receive personal information about you from someone else and we didn't ask for it, and it's not information we could otherwise have collected, we'll destroy or de-identify it where lawful and reasonable to do so.
4. Why We Collect, Use and Disclose Your Information
We collect, hold, use and disclose personal information for the following purposes:
- to process and fulfil your orders and recurring Nurture Kit deliveries, including selecting age-appropriate Nurture Kit contents;
- to create, manage and administer your Account;
- to communicate with you about your order, Account, deliveries, or support requests;
- to process payments and prevent or investigate fraud;
- to send you waitlist, launch and other marketing communications, where you've opted in, and to let you opt out at any time (see Section 7);
- to operate, personalise, and improve our Website, products, and customer experience;
- to conduct analytics on how our Website and Services are used;
- to run competitions, giveaways, and promotions you choose to enter;
- to notify you of product recalls or safety issues;
- to manage returns, refunds, and warranty claims; and
- to meet our legal and regulatory obligations, including under the Australian Consumer Law, product safety reporting requirements, tax and accounting laws, and the Privacy Act.
We collect, use and disclose personal information for the purpose we collected it for, or for a related secondary purpose that you'd reasonably expect, unless we have your consent, or another exception under the APPs applies (for example, where required or authorised by law). We do not sell your personal information to third parties.
5. Who We Share Your Information With
We disclose personal information to third parties who help us run Nurtory and deliver the Services, including:
- our e-commerce platform provider (Shopify) and payment processor, to operate our store and process payments;
- couriers and delivery partners, to ship your orders;
- email and SMS marketing platforms (such as Klaviyo), where you've opted in to marketing;
- IT hosting, analytics, and cloud storage providers, to run and secure our Website and systems;
- professional advisers, such as our accountant, insurer, or lawyer, where reasonably necessary; and
- regulators, law enforcement, or other parties, where required or authorised by law, or to establish, exercise, or defend a legal claim.
We may also disclose personal information in connection with a business transaction, such as a merger, acquisition, restructure, or sale of some or all of our business or assets, in accordance with applicable law.
These third parties are only permitted to use your personal information to provide services to us, and not for their own independent purposes, except where you've separately agreed to that use (for example, by opting in to a payment provider's own loyalty program).
6. Sending Personal Information Overseas
Some of the third parties we use to provide the Services store or process personal information outside Australia. For example, our website hosting platform, payment processor, and marketing platforms may store or process information on servers located in countries such as the United States, Singapore, or countries within Europe, depending on where those providers operate their infrastructure.
Before we disclose personal information to an overseas recipient, we take reasonable steps, consistent with Australian Privacy Principle 8, to ensure that the recipient doesn't breach the APPs in relation to that information — including by relying on contractual protections with our service providers. If you'd like more information about the countries in which our overseas service providers are likely to store or process your personal information, contact us using the details in Section 15.
7. Direct Marketing
We'll only send you marketing emails or SMS if you've opted in, consistent with the Spam Act 2003 (Cth) and the Privacy Act. Every marketing message we send includes a functional unsubscribe link or opt-out instructions. You can also update your marketing preferences at any time by contacting us or through your Account settings. If you opt out of marketing, we may still contact you for non-marketing purposes, such as order and delivery updates, or to respond to a support request.
8. Children's Information
Because Nurtory curates Nurture Kits based on your child's age, we collect your child's date of birth, expected due date or age range from you, the account holder — not directly from your child. We limit our collection of information about your child to what's reasonably necessary to select and deliver age-appropriate Nurture Kit contents and to send you, the account holder, updates relevant to your child's stage. We don't use it for any other purpose, and we never market directly to children.
You may request access to, correction of, or deletion of information we hold about your child by contacting us at support@nurtory.com.au. As with any request under this Policy, there may be circumstances where we're not able to fully action a request — for example, where we need to retain limited information to meet a legal obligation.
9. Cookies and Similar Technologies
Our Website uses cookies and similar technologies to remember your preferences, keep your cart and checkout working, understand how visitors use our site, and, where applicable, support advertising. The table below summarises the categories of cookies we use.

You can manage or delete cookies through your browser settings, and where available, through a cookie preference tool on our Website. Blocking or deleting cookies may affect how parts of our Website function, including your ability to check out. Our Website does not currently respond to browser "Do Not Track" signals.
10. Data Security
We take reasonable technical and organisational steps to protect the personal information we hold from misuse, interference, loss, and unauthorised access, modification, or disclosure — including by using secure, reputable third-party platforms for payments, hosting, and data storage, and by limiting access to personal information to personnel and service providers who need it to perform their role.
No method of online transmission or storage is completely secure, and we can't guarantee absolute security. If we become aware of a data breach that's likely to result in serious harm to you, we'll notify you and the Office of the Australian Information Commissioner (OAIC) as required under the Notifiable Data Breaches scheme.
11. How Long We Keep Your Information
We keep personal information for as long as reasonably necessary to fulfil the purposes described in this Policy, including to provide the Services, meet our contractual and legal obligations (such as tax and consumer law record-keeping requirements), resolve disputes, and enforce our agreements. Where we no longer need personal information for these purposes and aren't required by law to keep it, we'll take reasonable steps to destroy or de-identify it.
12. Accessing and Correcting Your Information
You have the right to ask us for access to the personal information we hold about you, and to ask us to correct it if it's inaccurate, out of date, incomplete, irrelevant, or misleading. If you have an Account, you can review and update most of your details directly through your Account settings. For anything else, contact us using the details in Section 15.
We'll respond to access and correction requests within a reasonable timeframe, generally within 30 days. We may need to verify your identity before actioning a request. In some circumstances permitted by the Privacy Act, we may not be able to give you full access or make a requested correction — for example, if doing so would unreasonably affect the privacy of others — in which case we'll explain why, and, where relevant, how you can complain about our decision.
13. Your Rights and How to Make a Complaint
Under the Australian Privacy Principles, you have the right to:
- know what personal information we hold about you and why (see Sections 2–5);
- access and correct your personal information (see Section 12);
- opt out of direct marketing at any time (see Section 7);
- deal with us anonymously or under a pseudonym where it's practicable for us to allow this; and
- make a complaint if you believe we've mishandled your personal information.
If you believe we've breached your privacy or handled your personal information inconsistently with this Policy or the Privacy Act, contact us using the details in Section 15. We'll investigate and aim to respond within a reasonable timeframe, generally within 30 days. If you're not satisfied with our response, you can lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au, by calling 1300 363 992, or by mail to GPO Box 5218, Sydney NSW 2001.
